
NEW QUOTAS ANNOUNCED BY MINISTER OF HOME
AFFAIRS
The Minister of Home Affairs has just
gazetted the updated list of professions and occupational categories
which are enabled in terms of Section 19(1) of the Immigration Act
No. 13 of 2002 in respect of quota work permits.
The professions and occupational categories as they appeared in the
prior quota list have remained the same save for the following
changes:
The amount of teachers has been reduced from 4000 to 2000;
It is now compulsory for each profession or occupational category to register with the respective professional body for their trade, profession or occupational category.
This latter requirement is going to present
some difficulties. Many of these professions and trade or
occupational categories do not require South Africans to register
with them.
By way of example the Engineering Council of South Africa (ECSA) is
not a pre-requisite to a South Africa Engineer practising his or her
proffession. It is my professional opinion that this is rather
unfair but perhaps understandable in terms of verification of
foreign national’s qualifications and professional registration.
A further complication, by way of example with ECSA is that it can
take upwards of six (6) months to affect such registration.
The Law Society of South Africa will be making representations to
the Director General of Home Affairs regarding this aspect in due
course.
