DEPARTMENT OF HOME AFFAIRS IN COLLABORATION WITH THE SOUTH AFRICAN INSTITUTE OF CHARTERED ACCOUNTANTS (SAICA) HAS RELEASED A GUIDELINE DOCUMENT REGARDING CERTIFICATE REQUIRED IN TERMS OF THE IMMIGRATION ACT NUMBER 13 OF 2002

 

Much confusion has surrounded the actual practical implementation of the numerous Chartered Accountants Certificate that are required in terms of the Immigration Act number 13 of 2002 and its Regulations.

In fact a viewpoint was taken by some Chartered Accountants that some of the Certificate called for are impossible.

An article dealing with the practical technicalities thereof is in preparation by our office and will be published on this website shortly.

However, at this stage it is of more practical importance to deal with the situation as it currently stands as these requirements are laid down in terms of the Act and Regulations at this time.

The current Regulations in force are interim Regulations and the process of finalising the final Regulations is currently before the Immigration Advisory Board and therefore any information given in terms of this article must be read against that background.

In terms of Passport Control Instruction number 92 of 2003 dated the 3rd October 2003, the Department of Home Affairs has spelt out that in recent meetings with the South African Institute of Chartered Accountants (SAICA) they have compiled a document containing guidelines to meet the requirements of the Immigration Act where a Chartered Accountants certification is a requirement.

Inter alia, the document spells out that this has been done in order to ensure consistency in the issue of Chartered Accountant Certificate.

It is incumbent on an applicant in an application for temporary or permanent residence to ensure that the Chartered Accountant who is certifying the documentation is indeed a registered Chartered Accountant.
